Terms of Service

These Terms govern your use of AnyAnalytics, the analytics service operated by Vexil LLC ("we", "us"), including the dashboard, APIs and SDKs (the "Service"). By creating an account or using the Service you agree to them. If you use the Service for a company, you confirm you may bind it to these Terms, and "you" means that company.

AnyAnalytics collects events that your games, apps and websites send through our SDKs and APIs, and shows reports about them. We host and operate the Service; you don't receive a copy of its software. We may improve or change features over time, and will tell you in advance about changes that take away something you pay for.

• You must give accurate account details and keep your password secure.
• Organizations group projects and members. Owners and admins manage members; owners manage plans and payment, and are responsible for what members do in their organization.
• Read API keys are secrets: keep them safe and revoke any that leak. Write keys are built into your apps and websites and can only send data; revoke and replace any that are abused.
• You must be at least 16 years old, or the age of digital consent where you live.

• Each account's first organization gets a free trial (currently 7 days) with no card required. When it ends, the dashboard asks for a plan before showing reports again; we keep collecting your events for at least 30 days after that, and may stop accepting or delete data of organizations that still have no plan.
• Paid plans are billed monthly or yearly in advance through our payment processor, and renew automatically until cancelled. Prices exclude taxes, which are added where required.
• Each plan includes an allowance per billing period: monthly active players for games and apps, and events (every event a website sends: pageviews and custom events such as payments) for websites. An organization with both draws them from one shared allowance, in any mix, as shown on the pricing and Plan & usage pages.
• Going over an allowance never stops data collection (technical rate limits against abuse still apply). We'll notify you and may ask you to move to a plan that covers your usage; repeated, substantial overuse on a plan may lead to a required upgrade.
• You can cancel or change your plan at any time from the Plan & usage page. Plan changes are prorated: an upgrade is charged for the rest of the period and a downgrade is credited to future invoices. Cancellations take effect at the end of the current period; we don't refund partial periods unless the law requires it.
• If a payment fails, our payment processor retries it and emails you. Organizations that stay unpaid lose access to reports until payment is made; data collection continues.

You own the data you send to the Service ("Customer Data"). You give us permission to store and process it only to run, secure and improve the Service for you, as described in our Privacy Policy.

For data about your players and visitors, you are the controller and we process it on your behalf. You are responsible for having a lawful basis to collect it, for informing your users (for example in your own privacy notice), and for any consent your jurisdiction requires.

Don't send us passwords, payment card numbers, government IDs, health data or other special categories of personal data, and don't knowingly send personal data of children under 13 (or the applicable age) without verifiable parental consent.

You can export or delete a person's data, and delete whole projects, with the tools in the dashboard. To close your account, email support@vexil.io: we delete your Customer Data within 30 days, except where the law requires us to keep it, and it leaves our backups within a further 14 days.

• No illegal tracking, and no tracking of people without the notices or consent the law requires.
• No attempts to access other customers' data, probe or break our security, or bypass limits.
• No sending of traffic meant to overload the Service, and no reselling it without our written agreement.
• No reverse engineering of the Service, except where the law expressly allows it.

The Service and all its software are proprietary to Vexil LLC. Our SDKs are licensed to you under the AnyAnalytics SDK License that ships with each SDK: you may include them in your own games, apps and websites to use the Service. Feedback you give us may be used freely to improve the Service.

We work to keep the Service available and your data safe, but we don't promise uninterrupted or error-free operation. Planned maintenance is announced where practical. Support is by email at support@vexil.io.

You may close your account at any time by emailing support@vexil.io. We may suspend or end access if you seriously or repeatedly breach these Terms, don't pay, or if needed to protect the Service or others; where reasonable we'll warn you first and give you time to export your data.

The Service is provided "as is" and "as available". To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.

To the extent the law allows, neither party is liable for indirect, incidental or consequential damages, or lost profits or revenue, and our total liability for any claim is limited to the amounts you paid us for the Service in the 12 months before the claim. Nothing here limits liability that can't be limited by law.

We may update these Terms. For material changes we'll notify organization owners by email or in the dashboard at least 30 days before they take effect. Continuing to use the Service after that means you accept the updated Terms.
